Terms and Conditions

Basmati Software (the "Service") provided by Basmati Software, LLC. ("Basmati Software") with permission of your local school, local school district,
teacher, or other responsible education authority (the "Subscriber") is made available to you (the "User") subject to the following Terms and Conditions in the Basmati Software Service Agreement (the "Agreement"). By using and accessing this Service, you are agreeing to be bound by, and to comply with, these Terms and Conditions and any other terms and conditions or terms of service posted on any individual page of this Service.

Violations of Terms and Conditions

Should you violate these Terms and Conditions or any other rights of Basmati Software, Basmati Software reserves the right to pursue any and all legal and equitable remedies against you, including, without limitation, terminating any and all user accounts. If Basmati Software should fail to enforce any right or provision in these Terms and Conditions, you agree that this failure does not constitute a waiver of such right or provision or of any other rights or provisions in these Terms and Conditions. If a court should find that one or more rights or provisions set forth in these Terms and Conditions are invalid, you agree that the remainder of the Terms and Conditions shall be enforceable and that, to the extent permitted by law, the court shall give effect to the parties' intentions, as reflected in any such right or provision that has been declared invalid or unenforceable.

Internet Privacy & Security

Basmati Software and your school (or teacher) work together to protect the online privacy of all of your school community members that use Basmati Software, including students, parents, teachers, and administrators.  Basmati Software information collection, security, and privacy policies have been authorized by your school or teacher, and Basmati Software strives to manage your school's internet services in a secure manner.   For example, Basmati Software uses industry standard SSL (secure socket layer) encryption to transfer private, personal information, the same technology used by online banks.  Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure, and Basmati Software can not ensure or warrant the security of any information managed by the site, whether transmitted to Basmati Software by you, your school, or your teacher.   By agreeing to Basmati Software's privacy policy and terms of use, you agree to use Basmati Software at your own risk, and agree that Basmati Software shall not be liable if a security breach occurs, if the site malfunctions, or if information is misused or mismanaged in any way to your detriment or the detriment of a third party, whether by Basmati Software, your school, your teacher, or an unauthorized third party.

Information Collection & Disclosure

Basmati Software collects data on how the service is used in the aggregate (how groups of people use Basmati Software) for the purpose of improving and enhancing its service.  For example, Basmati Software might learn that school news and announcement pages receive a great deal of traffic, which might influence how this aspect of the service is delivered in the future.  Basmati Software does not collect information on how particular individuals use the service.

Basmati Software does require that all users create a screen name and password, which is stored on the site.  It
is your solely school's decision to store personal information at this site.  By default,
student names are not stored at this site, however, your school may opt to do this
depending on the needs of your school or the service.  This information is not given or sold to any third parties, unless required by your school as part of their information management efforts. For example, if your school uses a certain third party company to manage their classroom scheduling and attendance system, necessary information may be shared with that company to assist in those administrative tasks.

These information collection, management, and disclosure practices apply to parents, teachers, administrators, and students.  If you are a parent, you agree that this is acceptable for you as well as any of your children that use Basmati Software.  If you are a teacher, you agree that this is acceptable for you as well as any of your students that use Basmati Software.

Deactivation
------------
If you are the parent and guardian of a student using Basmati Software, and cease to agree with Basmati Software's terms of use and privacy policy at some
point in the future, you must contact your child's school or teacher directly and ask that they remove your student from this service.

Third Party Content

Basmati Software is a distributor (and not a publisher) of content supplied by Subscriber, third parties, and visitors. Accordingly, Basmati Software has no more editorial control over such content than does a public library, bookstore, or newsstand. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, members or any other user of this Service, are those of the respective author(s) or distributor(s) and not of Basmati Software. Neither Basmati Software nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose.

By using this service, you acknowledge that you have read the Terms and Conditions, that you understand them, and that you agree to be bound by the terms and conditions contained therein. If you are a parent, you agree that the service and its terms of use are acceptable for any of your children that may use Basmati Software. If you are a teacher, you agree that the service and its terms of use are acceptable for any of your students that may use Basmati Software. If you do not agree to the Terms and Conditions regarding your use of this Service, you will not be permitted to use this Service.
